TECHNICAL DEPTH

LRBAs, property, pensions, Division 296.

Most SMSFs hit at least one technical matter during their life. Starting an account-based pension. Holding business real property. Taking on a limited recourse borrowing arrangement. Navigating the Division 296 tax (which commences 1 July 2026). Each of these has its own rules, and getting any of them wrong is expensive.

We handle these in our standard administration scope, subject to the engagement structure for your fund. Our team has worked across hundreds of funds with complex features and we keep current on legislative change so you don’t have to.

This is general information only and does not take your personal circumstances into account. For advice tailored to your situation, speak to a licensed financial adviser.

Shaun provides a steady and reliable source of advice on running an SMSF, and backs it up with solid research in this shifting landscape. Unlike our previous SMSF provider, Shaun is accessible and responsive to questions giving us confidence in our decisions and direction for our retirement savings.

AUDIT INDEPENDENCE

Your auditor is independent. Always.

SMSF auditors must comply with the independence requirements in APES 110 — the Code of Ethics for Professional Accountants — as picked up by the SIS Regulations and SIS Act. We work with an approved SMSF auditor registered with ASIC. You’re told who audits your fund. The audit fee is disclosed separately from our fee.

Pension administration (account-based pensions and TRIS) is included at every tier. Your tier is set by the investments your fund holds.

The audit fee of $385 incl. GST is included in the Entry, Enhanced and Extended annual fees and itemised separately on your invoice; audit is likewise included in bespoke engagements and confirmed in your proposal. If the auditor identifies an audit contravention, Auditor Contravention Report assistance is charged at $275 incl. GST.

FREQUENTLY ASKED

Administration, answered.

When is the SMSF annual return due?

It depends on whether a tax agent lodges the return and the fund’s history. Four scenarios under the ATO registered agent lodgment program:

  1. Self-prepared SMSFs — 31 October following the financial year end
  2. Tax-agent-lodged, newly-registered SMSF (first return) — 28 February (unless the ATO advised a 31 October date at registration finalisation)
  3. Tax-agent-lodged, established SMSF in good standing — 15 May the following year (the standard tax-agent program due date)
  4. Funds with overdue prior-year returns — pulled forward to 31 October regardless of agent status, until prior years are caught up

A separate 31 March deadline applies to funds with total income above $2 million in the latest year lodged.

A competent administrator should have most funds done well before 15 May. Funds that hit 30 April still in audit are exposing the trustee to last-minute pressure, and pressure leads to mistakes.

What happens if I’m late lodging my SMSF annual return?

There are three layers of consequence for a late SMSF annual return.

Failure to Lodge (FTL) penalty. Under section 286-75 of Schedule 1 to the Taxation Administration Act 1953, the ATO can apply 1 penalty unit for every 28 days (or part) the return is overdue, capped at 5 penalty units. The current penalty unit value is $330 (set by section 4AA of the Crimes Act 1914 for offences committed on or after 7 November 2024). Maximum FTL exposure for a small entity SMSF: 5 × $330 = $1,650 per overdue return. Note: the penalty unit is indexed periodically — Treasury indexation under s4AA Crimes Act 1914 is due on 1 July 2026, so the figure may change. Confirm the current value at the date of any specific situation.

General Interest Charge (GIC) on any unpaid tax. Under sections 8AAB–8AAH TAA 1953, GIC accrues daily on any unpaid tax debt. The rate is updated quarterly by the ATO.

Loss of complying-fund status. Failure to lodge is one of the triggers for the ATO to issue a notice of non-compliance. A non-complying SMSF loses its concessional 15% tax rate and is taxed on ordinary income at 45% (the top marginal rate) — section 295-555 ITAA 1997. The ATO publishes the fund’s status on Super Fund Lookup as “regulation details removed”, which restricts the fund from receiving employer contributions and rollovers.

The ATO will normally warn before applying penalties, and remission is available where there’s a reasonable excuse and lodgement is brought up to date — but the better strategy is not to be in this position. Proactive lodgement well before the due date avoids all three layers.

What data feeds do you support?

Hundreds of automated feeds via BGL Simple Fund 360 — covering most major Australian banks, brokers (CommSec, NABTrade, etc.), investment platforms (Macquarie, Netwealth, HUB24, BT, etc.) and wraps. If we don’t have a direct feed for a specific holding, we’ll discuss the manual workflow.

How do I switch from my current administrator?

We drive the process. Total trustee time is typically under one hour. See the SMSF Switching page for the full handover.

Who audits my fund?

An independent SMSF auditor from our approved panel. We name them. The audit fee is invoiced separately by the auditor.

What if my fund doesn’t fit a standard tier?

Some funds sit outside Entry, Enhanced or Extended, usually because of structural or historical complexity rather than an unusual asset: multiple LRBAs or bare trusts, legacy or defined-benefit pensions, reserves, in-house asset rectification, members overseas, unlisted and private investments, or several years of returns outstanding.

These are bespoke engagements. We scope the work and quote it in writing before anything starts, so the number you agree is the number you are invoiced. See the Bespoke option in the fees above, or book a fund review to talk it through.

Can you help me start a pension from my SMSF?

What we handle administratively.

When a member moves from accumulation phase to pension phase (most commonly an account-based pension), there’s a defined sequence of administration:

  • Pension documentation — minute of trustee resolution, pension agreement, and updates to member records to reflect the pension commencement date and starting account balance
  • Actuarial certificate where one is required — broadly, where the fund has both accumulation and pension assets and uses the proportionate (unsegregated) method to claim exempt current pension income (ECPI). The actuarial certificate is required for the fund’s tax position under sections 295-385 / 295-390 ITAA 1997 and the methodology in regulation 295-385.01 of the Income Tax Assessment Regulations 1997
  • Minimum payment monitoring — under regulation 1.06 of the SIS Regulations 1994 (and Schedule 7), a minimum payment must be made each financial year based on the member’s age and starting account balance. We track this throughout the year, not at the end, so that the minimum is hit before 30 June
  • TBAR reporting — pension commencements are reportable events for the transfer balance account regime; TBAR lodgement timing is within 28 days of the end of the relevant quarter
  • ECPI calculation and tax return treatment — the ECPI claim flows into the SMSF annual return

What we don’t do.

Whether you should commence a pension at all — and which pension type, and timing relative to age, work test, transfer balance cap, contributions strategy, and broader retirement plan — is personal-advice territory. We don’t answer that. Speak to a licensed financial adviser before commencing a pension.

What is Division 296 and does it affect me?

Division 296 is now law and commences from 1 July 2026.

Both the Treasury Laws Amendment (Building a Stronger and Fairer Super System) Act 2026 and the Superannuation (Building a Stronger and Fairer Super System) Imposition Act 2026 received Royal Assent on 13 March 2026. Division 296 was inserted into the Income Tax Assessment Act 1997 and applies from the 2026–27 financial year onwards.

The basic mechanics:

  • The tax applies to individuals (not funds) whose total superannuation balance (TSB) exceeds the Large Super Balance Threshold (LSBT) of $3 million at the end of the financial year. Indexation in CPI increments applies in future years.
  • An additional Very Large Super Balance Threshold (VLSBT) of $10 million triggers a higher tax rate on the proportion of earnings above $10 million.
  • The tax is 15% on the proportion of relevant superannuation earnings that relates to the part of TSB above $3 million; an additional 10% applies to the proportion above $10 million.
  • Earnings are calculated on a realised basis — the original proposal to tax unrealised gains was removed during the legislative process.
  • A once-off CGT cost-base reset election is available for SMSF assets at 30 June 2026 — irrevocable, fund-level (all-or-nothing), and applies only for Division 296 calculations. The ordinary CGT cost base for fund income tax purposes is unaffected.

For SMSFs specifically:

  • Multi-member funds will need an actuarial certificate to attribute fund-level Division 296 earnings to individual members (single-member funds are excepted).
  • New reporting items will be added to the SMSF annual return for the 2026–27 financial year onwards.
  • The first test date is 30 June 2027; the first assessments are expected after the 2026–27 SMSF annual return is lodged.

What we administer.

The Division 296 attribution calculation, the actuarial-certificate workflow, the optional cost-base-reset election, the new SMSF annual return reporting, and the supporting documentation for any member whose TSB approaches the $3 million threshold.

What we don’t.

Whether you should withdraw, restructure, or alter your contribution strategy in response to Division 296 is a personal-advice question. We don’t answer that. Speak to a licensed financial adviser.
