BENEFITS & CONTRIBUTIONS
Pension and contribution paperwork.
The documentation that effects a pension establishment, a commutation, a contribution split, a benefit payment. Prepared by SMSF specialists, technically reviewed, and returned ready to execute.
WHO THIS IS FOR
Documentation, not advice.
Whether to start a pension, what type of pension to start, whether to commute and re-start, whether to split contributions to a spouse, or whether to make any other strategy decision. These are personal-advice questions. We don’t answer them. We prepare the documentation that effects a decision the trustee has already made on advice.
Speak to a licensed financial adviser before commissioning any of these documents. The trustee’s decision sits behind the documentation.
Document services are typically used by trustees handling administration in-house, by accountants and advisers who don’t keep an in-house specialist resolution library, and by funds we don’t otherwise administer.
We’re a registered tax agent, not a law firm, and we don’t provide legal advice. The deeds and documents in our packs are prepared by WE. SMSF using legal documentation supplied by ACIS; anything that needs legal advice goes to a specialist SMSF lawyer.
PENSION DOCUMENTS
Establishment, consolidation, commutation.
Pension establishment
$330 incl. GST
Establishment of an account-based pension or a transition-to-retirement income stream within an SMSF. Includes pension document, opening resolutions, and supporting correspondence.
Pension consolidation
$330 incl. GST
Records the commutation of one or more existing pensions, and the establishment of a new pension combining the commutation proceeds with any remaining accumulation balance.
Pension commutation
$330 incl. GST
Documents the formal commutation of one or more pensions within the fund, and the treatment of the commutation proceeds.
Lump-sum from accumulation
$198 incl. GST
Records a lump sum payment from a member’s accumulation account within the fund, including the supporting resolutions and member correspondence.
Reversionary changes for existing pensions
$880 incl. GST
Documents the addition, removal, or replacement of a reversionary nomination on an existing pension. Whether this can be done without commuting and re-starting the pension depends on the pension’s terms and the deed, and the position isn’t settled. For some pensions the reversionary nomination is treated as a foundational term, so changing it may require the pension to be re-commenced, with transfer balance cap and other consequences. That’s an advice question, and we’ll flag it before drafting. Where a deed amendment is required, it’s quoted separately.
TTR transition to retirement phase
$330 incl. GST
Resolutions and minutes recording the move into retirement phase for an existing transition-to-retirement income stream once a condition of release with a nil cashing restriction has been satisfied.
LEGACY PENSION AMNESTY
Five-year window for legacy pensions.
A five-year amnesty allows full commutation of certain legacy pensions (market-linked pensions, complying lifetime pensions, and life expectancy pensions) out of the rigid legacy structure and into accumulation phase, a new account-based pension, or out of super as a lump sum. The window runs from 7 December 2024 to 6 December 2029. The amnesty carries specific eligibility conditions and tax consequences, and whether to use it for a particular member is an advice question.
Market-linked pension commutation under the amnesty
$800 incl. GST
Documents the full commutation of an MLP under the amnesty and the treatment of commutation proceeds (rolled to accumulation, used to commence a new pension, or paid out of super).
Eligibility and tax treatment is fact-specific. Speak to a licensed adviser before commissioning.
Complying lifetime pension commutation under the amnesty
$800 incl. GST
Documents the commutation of a complying lifetime pension under the amnesty and the treatment of commutation proceeds.
Reserve treatment, social security implications, and tax consequences are advice questions. Document recording follows the trustee’s decision.
CONTRIBUTION DOCUMENTS
Splits, deferrals, allocations.
Contribution splitting
$165 incl. GST
All documentation required to record a contribution split within an SMSF: letters, minutes, applications, and the statutory split form.
Deferring allocation
$550 incl. GST
Records the deferment of contributions received in one financial year and their allocation to a member in the next, including partially completed ATO requests.
HOW IT WORKS
What the process looks like.
STEP 1
Submit the request form
Fund details, member details, and the specific document or pack you need. Provide a copy of the trust deed.
STEP 2
We review and prepare
We check the deed against the request, prepare the documentation, and run the technical review.
STEP 3
You receive the pack
Delivered electronically, ready for execution. We’re available for execution-related questions during a defined post-delivery window.
STEP 4
You execute and retain
The trustees sign and retain the documents on the fund file. Where statutory forms are involved (e.g. contribution splitting), you lodge with the ATO.
Typical turnaround: 3–5 working days from a complete request, faster on simpler items.
