Trust Deed Amendment

Change of Trustee

The Fund’s existing trust deed will be reviewed to identify the proper process for effecting a change of trustee before preparing the documentation required to formalise that change.

While the precise contents will depend on the requirements set out in the Trust Deed and Governing Rules, the package will in all cases include a Change of Trustee Deed. All legal documents will be prepared in collaboration with a specialist lawyer from Abbot & Morley.
Changes to Fund Associates

Add or remove a member, director, or shareholder from the SMSF/Corporate Trustee company. As part of this service, the various Notices, Applications, Consents and Minutes required to record the changes will be prepared.

Limited Recourse Borrowing Arrangement – Third Party

Recognised Overseas Pension Scheme (ROPS) Registration

WE SMSF prepares the documentation to register the self-managed superannuation fund for ROPS.
This includes completing and lodging the required documents with HM Revenue & Customs on behalf of the SMSF Trustee.
A Trust Deed Amendment may be required to satisfy the definition of a Recognised Overseas Pension Scheme – this can be prepared by Heffron at an additional cost.

Company Constitution Upgrade

Where shareholders choose to change the purpose of a company, update the constitution, or replace a lost one, the documentation to upgrade the company's constitution will be prepared.

Relationship breakdown – Payment split

When a relationship breaks down and superannuation balances need to be split, obtaining a court order or superannuation agreement is only the beginning.

Within an SMSF, specific documents must be prepared and certain steps taken to give effect to the split and ensure full compliance with superannuation law.

As part of this service, we prepare all required documentation — including the notices prescribed under superannuation legislation and the trustee minutes needed to formally implement the split.
